Recently, I finally did something that had been sitting on my business to-do list for far too long — I trade marked my business name.
It’s one of those jobs that quietly sits in the back of your mind for years. You know you should do it, you keep meaning to do it, but when you’re running a small business there always seems to be something more urgent needing your time and money.
But the reality is, as small businesses, we simply cannot afford to find ourselves dealing with intellectual property issues further down the line. Our business names, branding and reputation are things we spend years building, often with huge amounts of passion, hard work and personal investment behind them.
Without trademark protection, there is always the risk that another business could start using a similar name, branding or identity. In some cases, businesses have even been forced to rename completely after years of trading because someone else registered the trademark first. Just imagine the cost and disruption that could cause — new signage, websites, social media handles, printed materials, lost recognition and confused customers.
For a small business, that could be incredibly damaging financially and emotionally.
What many people also don’t realise is that if another company legally owns the trademark, they may have the right to challenge your use of the name and potentially claim damages or profits connected to it. That can become an expensive and stressful situation very quickly for a small business.
It can also affect your credibility and ability to grow confidently. You spend years building a brand people trust, only to realise it may not actually be protected.
What surprised me most was how straightforward and affordable the process actually was. For the relatively small fee involved, the peace of mind alone makes it worth it.
If registering your trademark has been sitting on your own “one day” list like mine was, this is your sign to finally get it ticked off. Protecting what you’ve built is one of the best investments you can make in your business.
